Federal Appeals Court Blocks Lower Court's Injunction – Tariffs Remain in Effect
On June 10, 2025, the U.S. Court of Appeals for the Federal Circuit (CAFC) issued a stay on a ruling from the Court of International Trade, which had attempted to halt tariffs imposed under the International Emergency Economic Powers Act (IEEPA) by former President Donald Trump. This decision means the tariffs will remain in full effect during the appeal process.
In its per curiam order, the CAFC stated that "a stay is warranted under the circumstances" and acknowledged the "issues of exceptional importance" raised by the case. Notably, all active judges on the CAFC bench will participate in the review — a departure from the typical three-judge panel, highlighting the seriousness of the matter.
